The company Odinaut s. r. o. takes a responsible approach to the protection of personal data in accordance with applicable legal regulations. We have taken a number of technical and organisational masures to ensure adequate protection of the personal data processed by our company, respecting the rights of data subjects and the principles of personal data processing.
The legal framework for the protection of personal data includes mainly Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), and Act No 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts („Data Protection Act”).
Pursuant to Articles 13 and 14 of the GDPR and Sections 19 and 20 of the Data Protection Act, we inform you about the conditions of processing of personal data by our company and about your rights in the processing of personal data arising from applicable legal regulations.
Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to a commonly used identifier or an identifier such as a first or last name, or an online identifier. Any natural person whose personal data are processed is a data subject.

The personal data necessary for the conclusion and proper performance of a contract, including pre-contractual relations, with a data subject are processed. The personal data are processed in the following scope: title, first and last name, date of birth, address, telephone number and email address of the data subject.
The legal basis for the processing of personal data is the performance of a contract to which the data subject is a party, or the taking of steps at the request of the data subject prior to entering into a contract, within the meaning of Article 6(1)(b) of the GDPR. The provision of personal data is necessary for the conclusion and proper performance of the contract. Without the provision of personal data, it is not possible to conclude the contract in question.
For the purpose of including a person in a database of service providers, we process personal data about the person's expertise and data in the scope of the documents sent (CV/résumé, certificates, attestations, endorsements, LinkedIn profile URL), or other data provided by the person.
The legal basis for the processing of personal data is the consent given by the data subject within the meaning of Article 6(1)(a) of the GDPR. The provision of the data subject's consent to the processing of his or her personal data is voluntary. The data subject has the right to withdraw his or her consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Without the data subject's consent, he or she cannot be included in the database of service providers.
The personal data are kept for 5 years after the consent is given or until the consent is withdrawn by the data subject.
In order to comply with a legal obligation, we process the personal data of our customers, business partners or other data subjects within the scope defined in a special regulation. The legal obligation of the Controller arises from applicable legal regulations, in particular Act No 431/2002 Coll. on Accounting, Act No 222/2004 Coll. on Value Added Tax, Act No 595/2003 Coll. on Income Tax, Act No 40/1964 Coll., the Civil Code, Act No 513/1991 Coll., the Commercial Code, and other special regulations or international treaties by which the Slovak Republic is bound.
The legal basis for the processing of personal data is the fulfilment of the legal obligation of the Controller in accordance with Article 6(1)(c) of the GDPR, and the data subject is obliged to accept such processing of his or her personal data and to provide it for processing.
In order to streamline communication with those interested in the services, the Controller enables the sending of enquiries via an electronic contact form and an instant messaging system located on the Controller's website. For this purpose, the Controller processes personal data in the scope of name, email address and telephone number of the enquirer, or other personal data provided by the data subject via the form or the instant messaging system.
The legal basis for the processing of personal data is the consent given by the data subject within the meaning of Article 6(1)(a) of the GDPR. The provision of the data subject's consent to the processing of his or her personal data is voluntary. The data subject has the right to withdraw his or her consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Without the consent of the data subject, the enquiry in question cannot be recorded or processed. Personal data are stored for 1 month after the enquiry/message sent via the contact form has been processed. After this period, the personal data provided for the above purpose are deleted.
For direct marketing purposes (informing our customers and business partners about news and special offers related to our company's services), we may send marketing information, such as newsletters, to our customers and business partners in accordance with applicable legal regulations. For this purpose, we process the customer's email address, first and last name.
The legal basis for the processing of personal data includes Article 6(1)(f) of the GDPR and Section 13(1)(f) of the Data Protection Act – the processing is necessary for the purposes of the legitimate interests pursued by the Controller. The legitimate interests of the Controller include direct marketing in the form of news, special offers and ongoing promotions to the Controller's customers and business partners. It is possible to unsubscribe from the newsletter via the link at the bottom of the newsletter, by email or by post to the address of the Controller. Within the meaning of Article 21 of the GDPR and Section 27 of the Data Protection Act, the data subject has the right to object to the processing of personal data for direct marketing purposes.
For the purpose of informing interested parties about news and special offers related to our company's services, we may send newsletters or other marketing material to our customers, but only with the prior consent of the data subject (enquirer). For this purpose, we process the email address of the data subject. It is possible to unsubscribe from the newsletter via the link at the bottom of the newsletter, by email or by post to the address of the Controller.

In order to promote the sale of the Controller's services and to leverage social networks as a channel for communication with customers or potential customers, the Controller manages its accounts on social networks (Facebook, Instagram, LinkedIn).
The legal basis for the processing of personal data is the legitimate interest of the Controller in accordance with Article 6(1)(f) of the GDPR. The legitimate interest is in particular to increase interest in the Controller's services in the online environment. The personal data are stored until the relevant post is removed from the social network by the data subject or the Controller, or until the data subject objects to the processing of data for that purpose, or until the data subject requests the erasure of his or her personal data from the Controller's profile. The Controller may use the information about the use of the website or the activity on the Controller's social network profiles in aggregate form for statistical analyses for the purpose of improving the content and user experience of the visitors of the Controller's website or social network profiles.
In order to ensure the safe and reliable operation of information systems and the information security of the Controller, online identifiers (e.g. IP address of the device), cookies or other data which may in certain circumstances have the nature of personal data are processed.
The legal basis for the processing of personal data is the legitimate interest of the Controller within the meaning of Article 6(1)(f) of the GDPR. It is in the legitimate interest of the Controller to ensure network and information security of the operated systems. The processing of personal data for the above purpose is a legitimate requirement of the Controller. The storage period of these personal data is determined by the system settings of the information systems.

Personal data may be disclosed to our business partners for the purpose of providing outsourcing services and also to contractors for accounting, marketing services and website administration. At the request of the data subject, the Controller shall provide data on which processors are involved in the processing of the personal data of the data subject. Concerning the management of the Controller's accounts on social networks, the operators of the social networks also have access to the data. Further information on the operators of social networks can be found on the websites of the social networks.
Our company does not directly transfer personal data outside the EU, i.e. to third countries, and personal data are not subject to automated individual decision-making. We only process data in an automated manner (profiling) to find suitable jobs based on a person's technical knowledge and skills.
However, in certain circumstances, the transfer of personal data to third countries may occur, in particular in connection with the management of the Controller's accounts on social networks. In this case, the operator of the social network (e.g. Facebook, Instagram or LinkedIn) acts as an independent controller within the meaning of the GDPR, who determines the conditions of the processing and protection of personal data independently. Further information on the protection and processing of personal data is provided on the websites of social networks.
For the purpose of ensuring information and network security and the operation of systems, the Controller uses software running on servers located in the USA. The data transfer is carried out in accordance with the EU-U.S. Data Privacy Framework.
